Utah is a non-disclosure state: what that means for home prices

If you have looked up what a Utah home sold for and found nothing, you have met one of the state's quirks. Utah is a non-disclosure state. When a home sells, the sale price does not have to be recorded in the public record. The deed shows that the home changed hands, but not what was paid for it.

That surprises many people who are used to looking up sale prices on county websites. It also changes how buyers and sellers should think about the numbers they find online.

What is public, and what is not

The county recorder keeps the deed and other documents for every property. The county assessor keeps an estimated market value for property tax purposes. Neither is the same as the price a buyer actually paid.

The sale price itself usually lives in the multiple listing service, the shared database that real estate agents use. In most of the Wasatch Front that is UtahRealEstate.com. When a home listed on the MLS sells, the agents report the closing price there, which is why an agent can show you what nearby homes sold for even though the county does not.

Why online estimates can miss

Home value websites work best where sale prices are public. In a non-disclosure state they have less to work with, so their estimates can be further off than you might expect, in either direction. An estimate is a starting point for a conversation, not a price.

Homes that sell without being listed on the MLS, such as some private sales, may not show up in agent data either. That is one more reason a price opinion should come from someone who knows the local market and can explain how they reached it.

If you are selling

Pricing your home well matters more here, not less. Your agent should show you the recent sales they are comparing your home to, explain why each one is similar or different, and tell you what is happening with homes that are for sale right now, since those are the homes buyers will compare yours to.

If you are buying

Ask to see the sold homes your agent used when you discuss an offer. Look at how long similar homes have taken to sell and how their final prices compared with their asking prices. If you are using a loan, your lender's appraiser will also look at recent sales to support the value.

How we can help

We use the MLS records to show you what has actually sold near a home, not an online guess. If you would like a list of recent sales for your street or a home you are watching, contact The Luxury Agency and we will put it together for you.
